How should a company behave during a tax audit at its premises?

During a tax audit the company has specific rights under the Italian Taxpayers’ Charter (Statuto del Contribuente): to be informed of the reasons for and scope of the audit, to be assisted by a trusted professional from the outset, and to ensure the inspectors do not stay on the premises beyond the legal time limits. At the end a report is drawn up, and the company has a set period to submit observations before a tax assessment notice can be issued. Having support from the start reduces the risk of mistakes in handling the audit.

What should you do if you receive a tax assessment notice?

It must not be ignored: there are strict deadlines to respond. Depending on the case, options include a settlement agreed with the tax office (accertamento con adesione), a request for cancellation by the authority itself (autotutela) if there are obvious errors, or an appeal to the tax court. It is best to have it reviewed by a professional straight away, to choose the most suitable route before the deadlines expire.

What is a tax ruling request (interpello) to the Italian Revenue Agency?

It is a formal request in which the company asks the Italian Revenue Agency how it interprets a rule in a specific, concrete case, before acting. The answer binds the tax authority on that case: it is a useful tool when a transaction raises questions of interpretation and you want to avoid the risk of a future dispute.
