Frequently asked questions

How is an Italian company that sells abroad taxed?

A company based in Italy pays tax in Italy on all its income, wherever it is earned. Selling abroad mainly affects VAT, with different rules depending on whether the customer is a business or a private individual and whether it is inside or outside the European Union. If the company has a stable presence abroad (a permanent establishment), that income may also be taxed there: double taxation treaties exist to avoid paying twice.

Is it worth setting up a company abroad to pay less tax?

Choosing a country with lower taxation is not enough. If the foreign company is in fact managed from Italy, it may be considered tax resident in Italy (so-called “esterovestizione”); in addition, controlled foreign company rules may attribute its income to the Italian shareholder. Setting up a company abroad makes sense when there is a genuine business activity in that country: it must be assessed case by case, before incorporation.
